You, having seen the original documents, should enter the relevant evidence on the VOI and sign it. 2. A separate certificate must be completed for each applicant (e.g. joint holders, trustee cases and joint life cases). a) Where there is a third party involved (e.g. the payer of contributions) who is different from the applicant, that person must also be identified. b) Beneficiaries under a trust do not need to be identified when the investment is made or policy taken out (unless they are also the settlor). c) However, trustees should be made aware that, especially in the case of offshore and discretionary trusts, the identity of the beneficiaries will need to be verified before any payments are made to them. 3. Except where the Source of Funds concession is to be used (refer to 9 below), separate evidence must be obtained to verify identity and address. 4. Home visits can be certified as evidence of address only if the person completing and signing the certificate has entered the premises. 5. The AIFA Guidance states that the VOI submitted must be the original or a clean certified copy of the original VOI. Uncertified photocopies and faxes are not acceptable. The original VOI should be retained on the client file, and the certified copy submitted to the Product Provider with the proposal form. 6. Where the evidence submitted includes a photograph, (e.g. the new style driving licence); you must certify that the photograph bears a good likeness to the applicant. 7. The person signing the VOI must certify any photocopies of documentary evidence. a) Each photocopy must be individually certified with an original signature. b) Further certification of previously certified copies is acceptable provided the previous generation document bearing an original certification has been seen by the Company. 8. For Non-UK nationals, certified copies of equivalent documentary evidence may be submitted. a) A lawyer, attorney, embassy, consulate or high commission of the country of issue must certify passports, identity cards and documentary evidence of address for Non-UK Nationals. b) The adviser may re-certify copy documentation that they have obtained, provided that such documentation carries an original certification by an appropriate person from the aforementioned list. 9. The Source of Funds - postal concession. A cheque drawn on an account with a bank in the UK/EU is capable of constituting evidence of identity only where due consideration has been given to the circumstances surrounding the transaction and the associated money laundering risk is considered to be low. a) Issues to take into consideration in this context might include the type of investor, the nature and features of the product and the value of the transaction. b) Where the adviser is in any doubt as to the product provider's acceptance of the Source of Funds concession as a means of verification, they should contact the provider before accepting the application. c) Note in particular that the concession can only be applied: when payment is drawn on a UK/EU bank account in the name of the investor; and for the purchase of products considered to be low risk (e.g. long term life insurance or personal investment products) where funds cannot be transferred to another product and where funds cannot be repaid or transferred to third parties. However, each case must be considered individually in the light of the requirements set out in the relevant paragraphs of the Evidence Notes and, in particular, the restriction set out in paragraphs 4.94 and 4.100 must be taken into account. 10. Product providers can no longer accept an exemption from verification for a client who was an existing client prior to April 1994 (or prior to November 2001 for pensions clients.). A fully completed VOI, including reference numbers or certified copies of identification evidence will need to be submitted for these clients. 11. Normally evidence will be recent e.g. utility bill or mortgage statement. a) Evidence of the customer's identity obtained some years ago may be acceptable provided it is still current e.g. an unexpired passport. b) Older documents evidencing the customer's address will be acceptable provided the address on the evidence matches that on the application. 12. Please note that old style (non-photo) provisional driving licences are not acceptable. 13. When using the electoral roll as evidence or a solicitor’s letter confirming house purchase for address verification you must send a certified copy of your search or the letter, as appropriate. 14. Please note that when using a solicitor’s letter to confirm house purchase you must also supply evidence confirming the previous address. 15. Mobile telephone bills should not be accepted as they can be sent to different addresses. The JMLSG Guidance Notes (December 2003) confirms that the: a) original VOI is not required by Product Providers; certified copies are acceptable; b) certified photocopies of evidence is not required by Product Providers; the inclusion of relevant reference numbers etc. on the VOI will satisfy their obligations insofar as record-keeping is concerned. Higher standards of proof may be required for some high-risk areas (e.g. Corporate business) and the requirements should be discussed with the Product Provider.
